1.1 - These Terms of Participation and Privacy (hereinafter “Terms of Participation”) apply to the “WEEKLY RAFFLE: 100.000 $MXXR TOKENS” (hereinafter: “Sweepstakes”), organized by DXXR Holding B.V.  (trade name “maxxer” https://www.maxxer.com/) Rokin 52-2, 1012 KV Amsterdam, The Netherlands (hereinafter “Promoter”).

1.2 - Customers that are participating in the sweepstakes (hereafter “Participants”) agree to these Conditions of Participation, the General Terms and Conditions and the Privacy Statement.

2.1 - The campaign has a duration of 10 (ten) weeks. The campaign will start from 28 June 2022 until 6 September 2022.

2.2 - A sweepstake will be held weekly.

2.3 - Each weekly draw will be held on Tuesday, at 1pm (GMT+1) and only participation will be counted until this deadline.

2.4 - The Promoter may change the final date of the draws at any time, without prior notice to the participants.

3.1 - This sweepstakes is intended for all persons with a minimum age of 18 (eighteen) year

3.2 - Participation in the sweepstakes is free of charge.

3.3 - To participate, the customer must be registered or register with the IEO (Initial Exchange Offering) https://ieo.maxxer.com/. The identity of the participant must be verified and validated by maxxer to be eligible for participation.

3.4 - To participate, the customer must hold a minimum amount of $MXXR tokens worth € 10,- (ten euro) or R$50 (cinquenta reais) at minimum, in their maxxer account.

4.1 - Employees and family members of the Promoter, as well as employees and family members of cooperation partners who are or were involved in the creation or processing of these sweepstakes are excluded.

4.2 - Maxxer customers that have invested in the private sale of the $MXXR tokens are excluded from the sweepstakes.

4.3 - Participation by sweepstakes agencies and other entries and automatically generated bulk submissions is expressly excluded and will not be taken into account in determining the winners.

4.4 - Any entry sent after the deadline, incomplete, incorrect or entries that do not comply with all the conditions of the campaign described in the Terms of Participation, will be automatically excluded. Fraudulent participation or violations of the rules of these Terms of Participation will also be excluded.

4.5 - The promoter holds the right to exclude participants from certain jurisdictions and countries. 

4.6 - The Promoter may require participants to prove compliance with the conditions of participation in this campaign.

5.1 - In this draw, the Promoter will select a total of 10 (ten) winners. The total value of the prize package is therefore a maximum of 100,000 (one hundred thousand) $MXXR tokens per week during the duration of the campaign as set out in article 2.

6.1 - Each $MXXR equals token worth a participation. The more $MXXR tokens a participant has, the more likely they are to be randomly selected.

6.2 - The promoter will select the winner of $MXXR tokens by a random selection in an independent manner.

6.3 - Only one prize can be awarded for each participant.

6.4 - By not being selected for the prize of the week’s draw, the participant is automatically entered in the following week's draw.

7.1 - The winners will be notified no later than 14 working days after the weekly draw via email.

7.2 - The prize will be visible into the participants verified maxxer account, within 7 (seven) days after the winner was notified.

7.3 - The winner will only be able to start swapping or cashing out the prize 6 (six) months after the launch of the maxxer exchange and only 25% for each month. Specifically the swap or cash out would have to be according to the following scheme: 
• 25% 6 months after the launch of the exchange
• 25% 7 months after the launch of the exchange 
• 25% 8 months after the launch of the exchange and the remaining
• 25% 8 months after the launch of the exchange.

7.4 - Payment of the prize in cash or in kind is not possible, nor its exchange or transfer to other persons.

7.5 - A winner may waive their prize. In this case, a replacement draw will take place in accordance with article 6.2 of these Conditions of Participation.

8.1 - The Promoter is not responsible in any way for the conduct of the participants and for the content published by the participants within the scope of the draw and does not assume it as its own. 

8.2 - The Promoter reserves the right, at any time and without prior notice, to exclude from participation in the draw any participant who manipulates the draw, disturbs the holding of the draw or violates the rules of the draw or these Conditions of Participation. In this case, a replacement draw will take place in accordance with article 6.2 of these Conditions of Participation.

9.2 - The publicity of the sweepstake will be done through online communications and publications and via email marketing.

9.3 - The offer includes links to external websites of third parties or promotions on external websites of third parties, over which the Promoter has no influence. Therefore, the Promoter cannot assume any responsibility for these external contents. The responsibility for the content of the pages indicated by the links is always the respective provider or operator of the pages.

10.1 - Any questions, inquiries or complaints regarding this campaign should be clarified by email sent to the address support@mxxr.zendesk.com. Maxxer will respond by email within 90 days.

10.2 - Any claim relating to this campaign must be made within a maximum period of 90 days from the end of the campaign, under penalty of forfeiture of the right to claim.

11.1 - In order to carry out the draw, the Promoter processes the personal data of the participants, namely to inform them about a possible prize, which is done in accordance with maxxer's Privacy Statement.

11.2 - To the extent that the Promoter itself is responsible for the processing of the participants' personal data, the personal data will only be used within the scope of the legal provisions of the GDPR.

11.3 - All participants authorize and accept that the provision of data is necessary and mandatory for the purposes of processing the draw, determining the winners and delivering the prize. The data will be processed automatically and exclusively under the responsibility of the Promoter.

12.1 - The company reserves the right at any time without giving reasons (the organization) to discontinue the promotion or to change the promotion and/or these promotion conditions. 

12.2 - Change or adjustment of the Conditions of Participations and strike, change or adjustment of the promotion, will be done by the company and will be announced via the promotion page. The promotion conditions will not be changed to the detriment of the participants.

13.1 - Despite the greatest possible care taken by the Promoter in the management of the websites and the promotion, it is possible that the information provided is incomplete or incorrect. Printing or spelling errors or other similar errors in materials, of whatever nature, cannot be relied upon and cannot under any circumstances create an obligation for the Promoter in any way. 

13.2 - The company is not liable for any damage, of whatever nature, arising out of or in connection with(participation in) this promotion. Furthermore, the company is not responsible or liable forcosts incurred by the participant in connection with participation in the promotion.

13.3 - The participant indemnifies the company against claims from third parties in connection with non-compliance with these general terms and conditions of promotion or in connection with the act or omission of the participant.
